Welcome to Abled All Foundation ("AAF", "we", "our", or "us"). These Terms and Conditions ("Terms") govern your use of our website (the "Site") and all services provided by AAF. By accessing or using our Site, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our Site.

1. Acceptance of Terms

By using our Site, you confirm that you are at least 18 years old or are accessing the Site under the supervision of a parent or guardian. You agree to comply with all applicable laws and regulations regarding your use of the Site.

2. Intellectual Property Rights

Unless otherwise stated, AAF and/or its licensors own the intellectual property rights for all material on Abled All Foundation. All intellectual property rights are reserved. You may access this from Abled All Foundation for your own personal use subject to restrictions set in these terms and conditions.

You must not:

  • Republish material from Abled All Foundation
  • Sell, rent, or sub-license material from Abled All Foundation
  • Reproduce, duplicate, or copy material from Abled All Foundation
  • Redistribute content from Abled All Foundation

3. User Conduct

You agree not to use the Site in any way that:

  • Is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or invasive of another's privacy.
  • Infringes on any patent, trademark, trade secret, copyright, or other proprietary rights of any party.
  • Constitutes unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation.
  • Contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment.

4. Donations

All donations made through our Site are voluntary and non-refundable. We use third-party payment gateways (e.g., Paystack, Pesapal) to process donations securely. We do not store your full payment card details on our servers. By making a donation, you agree to their respective terms and conditions and privacy policies.

5. Disclaimer of Warranties

The Site and its content are provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied, including but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement. AAF does not warrant that the Site will be uninterrupted, error-free, secure, or free from viruses or other harmful components.

6. Limitation of Liability

In no event shall AAF, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Site; (ii) any conduct or content of any third party on the Site; (iii) any content obtained from the Site; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

You agree to indemnify and hold harmless AAF and its affiliates, directors, officers, employees, and agents from and against any liabilities, losses, damages, or costs, including reasonable attorneys' fees, incurred in connection with or arising from any third-party allegations, claims, actions, disputes, or demands asserted against any of them as a result of or relating to your Content, your use of the Site or Services, or any willful misconduct or gross negligence by you.

Our Site may contain links to third-party websites or services that are not owned or controlled by AAF. AAF has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that AAF shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

9. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of Kenya, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Site after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Site.
